"On 12/04/05 my washing machine broke down and I need to replace it for my family of five. The most competitive price listed was by a company called HypAudio.com at $998.00 plus $149.95 for shipping and delivery of a new US warranted machine. I submitted my Discover Card information and was charged $1147.95 immediately and received an invoice # 42860 stating that my machine would ship in 2-3 days. There were NO disclaimers presented to me prior to this purchase. I received an email on 12/05/05 requesting that I call the ‘Verification Department’ for this order. When I called, I was told that because HypAudio was not an Authorized Maytag reseller, the US warranty was void and my credit card was to be charged an additional $ 154.94, Invoice # 4047509 for a non-Maytag extended warranty. At this time I asked to cancel this order and was told that the order could not be cancelled. I sent sent an email to hypaudio.com detailing my complaints and canceling my order. On Tuesday 12/13/05 I received an email claiming that hypaudio would debit my credit card $507.00 for processing, shipping and restocking of this item that never left the local area. I responded to this email again detailing my complaints against this company. I discovered that there were no companies or DBA’s registered with the Secretary of State of New York with any variation of the name hypaudio or hypeaudio. I sent an email requesting the REAL name of the company in order to file complaints with the authorities. They refused to provide me with this information. ‘Customer Service’ sent me a very offensive email back (unsigned, as were they all) stating that no dispute resolution would be offered and all my emails would be blocked or deleted.

I worked backward from the shipping invoice and the REAL name of this company is: Thunderball Marketing, Inc., 10 Cragwood Road, Avedel, NJ, 07001. The responsible party for process service is: Ely Levy, 2134 Ocean Parkway, Brooklyn, New York 11223

"Worst company I have ever dealt with.I ordered a portable TV and paid 2nd day air. (mind you its not a backorder it is in stock). I placed the order over 3 weeks ago and have yet to recieve it. I called customer service and not only were they completely rude but they didnt even apologize for their mistake. They have also not refunded the over $25 I had to pay to 2nd day air it. They change prices and refuse to answer calls or emails. Their return policy is also completely crazy so you have to really read the fine print. I would not recommend this company to anyone-this is for your sake."

"I have purchased several times from them in the past, and have chalked up their few poor reviews I've seen on yahoo and other sites as mere hiccups. However, with my recent experience I must agree with the bad reviews and suspect the good reviews may have been posted by the company itself. I ordered a digital camcorder at a very good price, and of course I received the obligatory call stating the camera I wanted was out of stock, but they had a "package deal" including a long life batter and 10 dv tapes for about $100 more they could ship out right away. Being the schmuck that I am, and really wanting this hard-to-get camera, I took the deal. Well, the camera came in and was defective - I called them and was told I had to go through the mfg for repairs. And then they only shipped me 5 tapes... after frequent calls (their automated customer service only answers about 20% of the time) I was told I'd receive a $10 credit instead of the tapes. Needless to say, I'm not too happy and will NEVER buy from them again.... my next email is to the BBB. "

"So far, HYPEAUDIO has been my worst ever Internet shopping experience. This is an abbreviated version of the problems that I've had with HYPEAUDIO -- I didn't want this review to go on for pages.

1. I get an email from them saying that my credit card was declined. I call my credit card and they said that everything is fine and there haven't been any declines. I call (the phone is often busy so I have to keep redialing) HYPEAUDIO and they had the totally wrong credit card number, not even close to my credit card number.

2. I notice a $1,000 charge on my credit card but they never emailed anything notifying me that my products have been shipped.

3. I call HYPEAUDIO and they tell me that, yes, they did charge my card because the order is in the pipeline.

4. I call HYPEAUDIO the next day to find out the status of the order. I'm told that it's been sent to fullfillment and that it will be going out in the next few days. I called HYPEAUDIO because I didn't receive any emails from them.

5. I finally receive an email (see below) from HYPEAUDIO telling me to call them. I call them and they tell me that they're out of that color but I can buy it in a different color for an additional $60. I explain that they've charged my card nearly a week earlier and that I was told the order was already being sent out. He "apologizes" and said that if I can either wait another week or two for the silver monitors to arrive or pay $60 for the different color. I need the monitors for work (I program) and I can't wait a few more weeks so I place the order.

I've spent hours on the phone with these people for one reason or another and the order still hasn't been shipped. They might have had the lowest price, but the greatest amount of aggravation.

6. I finally receive the monitors. The boxes are beat to death. Restapled and labels torn off. I know this can't be a good sign.

I open the boxes and found that *both* monitors are obviously used and crudely repackaged.

I plug in the monitors and they're *both* dead. No wonder they've been returned.

They closed early on Friday so I couldn't call them.

I'll buy the monitors from someone else. Life is way too short to endure this much aggravation so that I can save a few bucks.

I checked out some other reviews of HYPEAUDIO and I found a number of people who've encountered similar experiences.

"my daughter ordered from them, and made a mistake with my credit card info. they cancelled the order. fine, that's ok. then they called my house and spoke with my son, and got the info from him and shipped it. but my daughter had already reordered elsewhere. my son had nothing to do with the order, and has no authority to give my credit card info out. i've emailed them with no response about returning the item, and they don't even have an answering machine on their phone. just rings then hangs up. also, they were charging $30 for shipping a camera by UPS ground. Beware!!!!! They are refusing a refund!!!!!!"

"I ordered a Samsung TXM3098WHF High Definition Television and paid for premium shipping. I thought I was ordering new (nothing on order indicated refurbished) and when TV came via standard shipment weeks after order, it was obviously refurbished. I tried to contact them but was absolutely unable to remedy deficiency. I decided to live with it, but less than three months after purchasing the TV, it started randomly shutting off. Samsung told me I have no warranty through them. Very bad situation: TV will cost nearly as much to fix as it did to buy. These people are frauds, crooks and any other negative label I can think of. DO NOT BUY FROM THEM!!!!!!!!!"

"I purchased a digital camera from HypeAudio and when my order came in I received a box with software, manuals, memory card, and some wires but no camera and no battery charger. I filled a complaint they did an investigation and responded that the weight of the package was 1 pound the same weight of the camera and if the box was empty the weight of the package would only have been a couple of ounces. I checked with the shipping company and they informed me that if a product weighs less than 1 pound they automatically round up to the next weight. Also I question as to why they would ship a $200+ product and leave it on the porch if no signature release was given. I'm still trying to resolve this issue with them. I should have checked the Better Business Bureau before placing the order with them. Customer service is also very rude."

"Horrible service. I placed the order on March 2nd, and received confirmation and it said my order would be shipped in 2-3 days. Even after seeing the 2-3 days thing i wasnt too happy, but decided i wasnt in a major rush. Afer 4 days, i then got an email notifying me that due to limited supply, my order wouldnt be shipped for another 5-7 days. At this point i called them and asked about it, they told me it would be shipped in 24-48 hours. Two days later i called again, they now said the order was sent to the wearhose, and i should get a tracking number later on. It still wasnt shipped, they didnt tell me this, but let me think that everything was good now. The next day i called back again, and told them i wanted to cancel the order, i was told that i cant cancel it, and i would have to just wait till it comes and decline the shipment, then when they get it back i would get my money back minus a 15% restocking fee. Not happy with this result, i called back again. When i told the representivie i that i wanted to cancel the order, he told me "theres no reason for the order to be canceled", and "why do you want to cancel it". Then when i explained how long i've been waiting, and that i can get the item (new) off ebay for cheaper, he put me on hold (without telling me, i just started hearing music). A few minutes later he picked up again and said "the order is canceled, goodbye" and hung up. When I called back i got someone else, and they looked it up and said the order isnt canceled, then after ~5 minutes of being on hold, they came back and told me it was, and answered my question reguarding when i will receive credit back on my card. I wouldnt deal with this company EVER again, and would advise anyone who is thinking about it to go buy their stuff ANYWHERE else. This is porbably the worst online shopping experience i've ever had, watch out."

"Hypeaudio is disorganized, dishonest and in my opinion fraudulent when it comes to the representation of their products being factory new. I ordered a Samsung HLN5065W on 01/06/2004 and was told I would have the item in 3 to 5 days. After 5 days I was told that due to limited deliveries from the manufacturer it was going to be 4 to 7 days. This happened several more times and by 01/26/2004 was fed up with not receiving my order. After more than 10 calls to customer service and complaining that they had done nothing to fulfill my order they offered me the option of getting the next higher up model the HLN567W HD DLP Tantus for and additional $300. I was assured by the customer rep that once again per the website that the product was factory new and they we're not doing a bait and switch. They did one better for $3,737.83 I received a refurbished TV with a copied owners manual and no other paperwork. All nicely boxed in a Samsung factory box. Oh I forgot to mention the white spot on the screen that appeared the instant I turned the set on. My 30 guests for the SuperBowl liked looking at the spot too. I found out from Samsung directly that the TV was a refurb because there was an R as the last digit of the serial number and that the set is not covered by Samsung guarantees. If you purchase items from Hypeaudio be sure to check you serial number with the manufacturer of your product to see if it is factory new. I came accross Hypeaudio via Nextag and Hypeaudio utilizes Yahoo shopping and Mysimon as well. I have bought electronics via the internet from other companies such as Etronics and have received what I ordered on time or earlier. Please be careful dealing with Hypeaudio. My case is in the hands of American Express now. If you deal with them make sure to use a credit card with consumer protection. Better yet, just shop elseware."

"I have and am encouraging anyone unhappy with this company to please call or write the New York States attorney General office.Also submit feedback here/ and at YAHOO & Bizrate.We as consumers and resellers should not allow them to wreck this system for all of us.They are less than honest- seldom keep rebate-cost reduction or price match for items they sell.They should be shut down.If we all raise a little hell with the Master/Visa card people-they will not be able to process these false claims and overcharges.They are not acompany i will ever deal with again.NO email responses and they care more about charging you a restocking fee then correctly filling orders."

"Although, their prices are excellent, their shipping costs are astronomical and delivery is very slow. There is a total lack of communication. Any inquiry generates a form e-mail to call an 888 number. The message is always that they are experiencing high call volume, call back later. I am still waiting for an 18.00 credit on an out of stock item. If I didn't call to request a credit, who knows????? I guess I'll never see my 18.00 now. Buyer Beware. There are much better places to shop."
