"Unbelievable ...

I placed this order almost a year ago, I was billed the same day, my items are YET to arrive >.<

Infact, the site says the items are out of stock now ...wheres my refund then upstategames ?!

This is fraud ...

No replies to any emails, no knowledge on how to take legal action .... $180 worse off ....

"My older son placed an order on July 1, 2003, for a Sony PocketStation for his younger brother, using our American Express account. The web site claimed that the item would be shipped in 4-7 business days. When it did not arrive, my older son, belatedly, checked this site and found out about the very poor performance of this reseller. I emailed Upstate Games and received no response. My American Express bill arrived and the account had already been charged, on July 2. After reading the reviews on this site, I was unwilling to cut Upstate Games much slack. A phone number was listed for the handler of Upstate Games' merchant account, 2Checkout.com, at 1-***-***-****. I called and learned they are only open M-F, so I left a message. They called me back, and apologized for my problem. They determined that the item had not been shipped. They offered to email Upstate Games, and by their policy, if the reseller did not respond within 48 hours to offer a refund. They did; he didn't; they did. The refund has already been credited to my American Express account, as of July 28, 2003.
Unfortunately, not a successful transaction, but at least not a costly one.
For others who have been charged but received no delivery from this reseller, if the charge was from 2Checkout.com, you have a recourse! Also, the complaints will probably insure that 2Checkout.com will no longer handle his merchant account, and he won't be able to bilk others in this manner.

"This company is the biggest scam I have ever seen. I ordered Elevator Action: Old and New for the Game boy sp, on 7/11/03 and I have still not recieved my order. "Ordered on the 23rd of March for my son's birthday on the 14th of April. Billed on the 30th of March. Dimitri said he would ship it on the 17th after I emailed, faxed, and called him. He lied. It finally shipped on the 29th, long after my son's birthday. I ordered one from Lik Sang in Hong Kong on May 2nd, delivered on May 5th. Damn, Lik-Sang.com is outstanding. Upstate Games just has HORRIBLE customer service."

"Ordered an ASCII Keyboard for GCN. Waited about three weeks for it, until I started emailing them to ask if they had shipped it/if they had any. I recieve the product on 4/9. I did send them two emails to see if they had the prodcuct, which they did NOT reply.

I would not recommend ordering from these people though.

"I placed an order with Upstate Games on March 11, 2003. As of April 5, 2003, I have not received the item ordered, even though Upstate Games collected the funds four weeks ago. I have written emails several times to Upstate Games but have not received a response. I would highly recommend not ordering from this company. If anyone has had luck receiving a refund from this company, please let me know. Also, if anyone has a phone number for this company, please email me as I cannot locate their phone number."

" I also purchased a Gameboy Advance SP import version on 2/25/03 my credit card was charged on 03/02/03. I have yet to see my order as of 03/19/03, I have emailed three times and each time I have been told I will be getting it within a couple of days. It has been three weeks now and still nothing. This company did not have the inventory it was selling and is taking money for items it doesn't have yet. Do not buy from this company, I will never again. "

"This company is absolutely the WORST! I ordered a Game Boy Advance SP (import) from them on the 16th. Listing on the website said "In Stock" Waited a week. Never got shipping confirmation. Sent several emails and never got a response. Finally I had to threaten to contact the BBB and cancel the charges on my credit card. He then responded with a very short email saying "sorry for the delay, these will be going out sometime this week". I waited another week and still no shipping confirmation. Several more emails without responses. I had to threaten again, and they emailed another response. They said "these haved shipped, you should get any day. Please be patient". BE PATIENT. 3 weeks later with crappy response time, threatening them to get them to respond, and he says "BE PATIENT" I still have yet to recieve the GBASP. I will never use this company again, and I hope this review will discourage all who are even thinking about it.

DON'T USE THIS COMPANY NO MATTER HOW CHEAP THE PRICE IS.

"Worst customer service. I placed an order for a PS2 VGA box on 5/26. Got no shipment email, no email about whether there is a problem. Sent an email on the 29th to check on the status. No reply. Sent it again 3 days later. Finally got a reply telling me: "If there isn't any problems processing your order you should be getting it by next week with priority mail." What does that supposed to mean? "IF?!" How was I supposed to know if there are any problems or not. I didn't get shipment email from them for a week, usually that means there IS a problem. That's the reason I eamiled them to see if there are any problems. And they tell me IF there isn't any problems. What the heck was the reply for then?! At the time, I thought at least there is a human being replying me, so I waited. Sent another email on the 4th no reply. Sent another email on the 7th, AGAIN, no reply, right now, it's been 2 weeks since I placed the order. "If there isn't any problems?" I say that's a problem. And they did not notify me of anything whatsoever. Finally I wrote them on the 11th to cancel the order at 6:13pm. got a reply from them 44 minutes later -Wow quick reply- (according to yahoo's time stamp) stating that they need to confirm my payment. Confirm my a$$. I have placed orders online with the same CC after I placed my order on upstategames.com using ground shipping and have gotten those orders already. Updstate have yet to even ship it. So there is NO problems with my CC. If there is no problem with my CC, what's the hold up? I ended up ordering from levelsix.com and am happy to say they shipped the vga box promptly and I am happy to pay for the few dollars that I thought I was saving by going with upstate. (both companies I've never heard before, so the chance I'm taking is the same. I went with the lower price BIG MISTAKE!)"
