I purchased the Guitar Hero 5 drum and mike bundle on September 29th 2009 partially because of the promise I would get the Van Halen Guitar Hero version for free. I received the bundle but there were no details about the Van Halen version in the box. I thought they would let me know if I had to do something to get the free VH version, but since I heard nothing, I assumed they would just ship it. Since then I’ve read, from other sources, that there should have been a sticker on the box…there was not. The release date came around and still nothing. I contacted them on Dec 28th and customer service passed me off to the “Van Halen Promotion” group. After giving them the confirmation and billing info, this is the response I received:

Good Afternoon,
Thank you for your e-mail. We regret that we are not able to accommodate your request. In the interest of fairness to all of our valued customers, we must process all redemption in accordance with the terms of the offer.
As such, the confirmaton form and sales receipt had to be received and/or post marked by October 31st to be valid for redemption. As stated in the terms of the offer, we assume no responsibility for lost or misdirected mail.
We do hope you enjoy Guitar Hero 5 and the largest selection of music in the history of Guitar Hero as well as great new innovative features like jump in/jump out party play and any selection of instruments you choose.

I would agree with this if they had told (or sent) me the terms of the offer and/or the confirmation form. They did not. “Fairness to all of our valued customers” means to me that they should honor the agreement they sold me. I was a repeat customer but I will not purchase from them again as they do not deliver what they promise, they blame it on the customer, and obviously have no interest in making it right.
Also, upon further research, I see that Red Octane (AKA Guitar Hero Store) has an “F” rating from the Better Business Bureau. So, I guess, shame on me for not checking them out ahead of time.

Every copy of Guitar Hero 5 included a sticker on the game jewel case labeled "Limited Time Offer", which detailed instructions on how to redeem the previously unreleased Guitar Hero Van Halen. In addition, shoppers at GuitarHeroStore.com were provided a "click for details" link on every Guitar Hero 5 product page prior to checkout, so that they would have all the details on how to redeem this offer prior to purchase.

Again, all redemptions have been processed in accordance with the terms of the offer. GuitarHeroStore.com made no implications that copies of Guitar Hero Van Halen would be processed outside of these terms.

We apologize for any confusion. As much as we would like to honor the request regarding this matter, we are simply unable to do so. ”
