I found a motherboard on Lynn Computer Products' web site that I was interested in. The item was marked "regular price" $199, on "clearance" for $139. As vendors with good feedback ratings on ebay are selling the same board (new) on ebay for $169 + shipping, it did not seem at all far fetched to find a new one on "clearance" for $139.

When I received the motherboard, I first noticed that the manufacturer's box was in ratty condition. After opening the box, I found that the contents in the box were in used condition. I immediately contacted Lynn Computer Products and made an enquiry about the condition of the merchandise I received. I pointed out that no where in their written ad did it say that the product was used. Lynn Computer Products stated that it was an oversight and that it should have said "refurbished."

I then advised Lynn Computer Products that I would not have ordered the motherboard had I known that the item was used. Since it was Lynn Computer Products' improperly worded ad that led me to order the board, I requested a full refund including shipping both ways. Lynn Computer Products refused to refund the shipping cost I paid to ship the board to me. Instead, I was given 2 options:

1.) If I returned the motherboard for a refund, they would split the return shipping cost ($7.50 credit) but not refund the original shipping cost of $15 I paid to ship the motherboard to me.

2.) If I returned the motherboard and paid the difference for another motherboard (one that sells for $215) they would waive the shipping cost for that board and also split the return shipping cost.

If I accepted option 1, I would be out of pocket $22.50 ($15 + 7.50) to get a $139 refund.

If I accepted option 2, I would be out of pocket $83.50 ($76 + 7.50) to upgrade the sale (which also puts more money in Lynn Computer Products' pocket)

The most cost effective option for me was to just keep the motherboard. I contacted MSI tech support and gave them the serial number for the board. They verified that it still had the balance of its 3 year warranty.

It was Lynn Computer Products' fault for improperly wording the ad. Lynn Computer Products should have accepted full responsibility and refunded all of my money. Instead, they punish their customers for their mistakes.

You guys decide whether or not you want to do business with a company like Lynn Computer Products.

Edit ==> 5/24/04

I like how they point out that "shipping is expensive....."

They still feel that the customer (me) is responsible even though it was their misrepresentation on the condition of the product. Not cool. I've filed complaints with their local BBB and Attorney General's office. Might not help me but perhaps the next person.

“Hi, this board was marked K7DMaster SALE, only 1 left! $139. It was microstar factory exchanged, not used, we have no control over this. It was sold to him with a 1 year dealer warranty, which is our default warranty as stated on his sales receipt. It was in stock for 2 years and the box may have been worn a little. He received a good board direct from Microstar for a great price. He called stated it was used and I said no its Microstar factory refurbished(which are usually repaired or new product)If we had listed as refurbished their would have only been 3 month dealer warranty. He wanted to exchange the KD7Master for the KD7MasterL, the latest version, and I told him fine, we would wave the cost of shipping the new board if he returned the old board. He was unwilling to pay even 1 shipping charge so we compromised and stated we would refund an additional $7.50, half the cost of returning it, which was more than enough to cover his cost to return by ground shipping. We never heard from him again, until now, sorry but shipping is an expense and not always refunded, we would have refunded in full including shipping if the board was DOA or failed but its in working order as far as we know.
IN CLOSING 5/29 We said shipping is an expense NOT "shipping is expensive....." Our return policy is clearly stated on our web site, however we are refunding this customer $15 shipping charge today, but the 30 day upgrade/refund period has expired. I hope he realized he is responsible for return shipping as posted on our website for all defective returns, tradeins or refunds. ”
