"UPDATE 03/24/2006: Anyone having any new problems PLEASE EMAIL ME (jimmy.owen@gmail.com) so I can forward the information on to you regarding the Tennessee State's Attorney General's Office and the action they are taking against Martin Fike!

UPDATE 03/20/2005: Martin Fike is now using the name swdiscounters on eBay, to hide from all of the negative publicity generated by all of our complaints to eBay.

I have received a reply from the Federal Trade Commission, and it looks like a regular auto-reply form. I would like everyone that has had a negative experience with BargainDepot04, AKA Consumer Depot, SurplusDealz, and Auction Logistix, to write to the FTC and use this number in the first line of the complaint form on their site at www.ftc.gov:
complaint Ref No. 5700020....the name of the owner is Martin Fike. The address is 3332 Powell Ave. Nashville, Tn. 37204.

Lets flood them with complaints on the SAME complaint number!!!!

I have contacted the Federal Trade Commission regarding this business's willfull selling of items on eBay that they KNOW are defective. In their auction details for an item that is defective, they describe the item exactly the same EVERY time. I am also filing a civil suit against bargaindepot04, (AKA ConsumerDepot, and Auction Logistix LLC), and will get it certified as a Class Action, as there are now over 100 members on eBay that are willing to join it with me. Look out bargaindepot. Get ready to pay!!

this company leaves retalitory negative feedback when it is rightfully left for them. i paid for 3 day shipping, and received my item 7 days later. Fed Ex shipped it in the 3 days AFTER it was ready to be shipped by bargaindepot. they held it until there was no time left for it to be returned.

"WORST EXPERIENCE EVER! Avoid like the plague. When calling for Customer Service, they hang up on me. They sold me defective IPOD and refuse to exchange or refund. "

"I ordered a camera labeled as DSC-W55 from this company. THey sent me the wrong camera. They sent me DSC-W150. They refuse to resolve this issue. To make matters worse I have ordered 4 other cameras in seperate orders and same thing.
Their response is items are AS-IS. That should be void when they send you the wrong item. This is fraud in my opinion, and i am very unhappy."

"Company will not issue RMA for defective merchandise. They are criminals, plain and simple. I wish I had researched more before losing my money.

First, item was not new, it had clearly been opened previously. Probably a customer return, which I expected. The auction indicated it would be in that condition. No complaints about that.

I clicked the RMA button 6 days after receiving merchandise. The ebay auction conditions clearly stated I had 7 days. Automated system said I was too late. I emailed (also within 7 days of receipt) to try to get this corrected, but got a rejection (might have been automatic) stating that no "exceptions" could be granted.

Funny he responds here, but won't respond to my request directly. Response said he is too busy to handle exceptions. ConsumerDepot, if you are willing to correct this situation, please email me through ebay. This seems to be my only avenue to reach you. Your email system ran me in circles the last time I tried that. I'm willing to be proven wrong. Please do so.

Final followup: Well, it has been 10 days since my offer to be proven wrong. Shock of shocks, I have not been contacted and definitely not received an RMA. I stick by my original statement, the guy is a crook."

“This is not true at all. Customer bought a brand new item from us on eBay. eBay Item #270118066388 If you look at the auction it says, "CLICK HERE TO GET AN RMA#". It is all automated. All you have to do is click the button. Customer is upset becuase he never clicked the button for an easy return.”

"This place is a scam set up...sell used/broke junk, charge 20% restocking fee, rinse and repeat. I ordered a ps3 80g metal gear solid pack that was advertised as new/open box for $395. I received it and it was obviously used, severly scratched and the memory card door was chipped bad. Turned it on and it doesnt recognize anything bluray, just ps2/ps1 and dvd's. Now they want me to pay to ship back and charge me a 20% stocking fee.STAY AWAY FROM THIS SELLER I READ THE REVIEWS AND SAID TO MYSELF, THEY HAD ENOUGH GOOD REVIEWS TO TAKE A CHANCE AND GOT BURNED!!!!!"

"I bought on Comsumerdepot the Bose Speaker Wire Adapter Kit and it was supposed to be brand new. I got one used, broken and one part was missing so I cannot use it!"

"Very shady business practices. They don't reply to emails or answer phone calls. Left two voicemails and never got a call back. Was sent a defective product that was missing parts. These guys are a scam, and most of their ratings on here are probably fake."

"This company scams it's customers! Marty Fike sells junk/broken items/missing parts, etc as new in box. He jacks up the shipping cost. Once the merchandise arrives at your home and you find it's not what was advertised or what you purchased, you can NOT get in touch with anyone to rectify the problem. They refuse to answer emails or phone calls. If you post neg. feedback, they automatically post negative feedback on you, and the feedback that they post doesnt even make sense (doesnt go with the situation). It's an automatic negative feedback system I guess! They claim they will refund your money if you are not satisfied, but not the shipping costs. You have to pay to ship back the defective merchandise only to get a refund, which most of the time, is less than $1.00. You only have 7 days to return the merchandise, and most, if not all of the time, the items are not even delivered until AFTER that 7 day period has expired! The 'customer' loses all the way around. Marty banks on customers not returning the merchandise. He then turns around and re-sells the SAME defective merchandise!! Most or ALL of the junk he sells is defective merchandise from stores like Best Buy. Some even have the stickers still on the items from the stores, marked Damaged or Defective or Missing parts! In his Ebay auctions, he does not reveal any of this information. I purchased a scanner and a Rival crock pot from him. Both items were damaged/not working. The scanner came without ANY power cords or USB/power cord. There's no possible way the scanner could have been tested to be in 'excellent and working' condition as was advertised in the auction! The crock pot was crushed on the back side and does not heat up when plugged in.
I paid $.56 cents for the scanner but the shipping was $20.00. The scanner arrived in a crushed box (not manufacturer's box as was advertised in the auction) and the ACTUAL shipping cost was less than $5.00. The crock pot was packaged the same way, with shipping cost at around $5.00 (I paid $18.00 for shipping). Channel 4 news team in Tennessee did an investigative report on this company and found them to be a scam artist company. If you go to Ebay and do a search for any of Marty's accounts, read the feedback pages! He sells on ebay and quite a few other auction sites, all with the same problems, over and over. This company should be put out of business!!!
