I ordered 2 hard drives from them on 1/30/08, but they did not ship them until 2/6/08. I had expected them to arrive before I left for a trip, but they didn't arrive until 2/7/08, after I had left. So, fedex ground left them on my doorstep. I didn't find the package when I got back on 2/10/08 so sent a note to the merchant asking them how to proceed. This is their response:

Thank you for contacting us. According to the fedex tracking information, the package was delivered on 2/7. If this package is missing or stolen, your sole recourse is with the carrier or with your homeowner's insurance. Please visit our sales terms,

Shipping Waiver of Liability
Once your order has been passed to the designated carrier, you agree to waive Atriniti of all liability financial or otherwise for any failure of delivery, including but not limited to packages lost or stolen after delivery, misdelivered packages, damage due to weather, and delivery without requiring a signature. You agree that Atriniti is not required to obtain signature at the time of delivery and you irrevocably waive any right of dispute for shipments made to you without a signature requirement. You agree that your sole recourse is with the carrier.
Fortunately for me, the package in question was held by a neighbor who became concerned about it after seeing it for a couple days on my doorstep. But, if it had actually disappeared, I would be out $500 as the merchant disclaims all responsibility and fedex has no apparent liability since the merchant did not purchase shipping insurance and selected the "delivery without signature" option.
