A 56k modem has the same max download speed as a V.90 or V.92 modem. The FCC has a "cap" of 53k/s on a dial-up connection. That's 53kiloBITS, not 53kiloBYTES. Therefore, 53 divided by 8 (8 bits=1byte) is 6.625kiloBYTES, which is the MAX theoretical download speed you can achieve on dial-up, except you have to figure in your phone quality and connection "overhead" which drops it to roughly 5K/s or less.
The fact that you're running 4K/s is a sign that you have a pretty decent connection. I don't know that upgrading your modem will grant you any additional speed, but if your ISP has V.92 service, you can utilize that to put your modem "on hold" if you only have one phone line.
