What drivers are you using for ya video card?
Perhaps a re-install of the video drivers may fix it up?

Hey jayman, it started when I upgraded to 44.03, then I went to 45.23
didn't happen with the older drivers and I haven't tried to roll them back to see, found a couple of people with the same problem but no solution, not even at futuremarks site
also I'm runing win98se, which isn't getting drivers certified anymore

Hmm... sounds like its a video card driver problem then...
May be an issue with the win98 version, or could also be an issue with the gf2mx support of the latest drivers problem.
I'd probably try rolling back to the driver you were using before 44.03 and take it from there.

If you haven't downloaded the latest patch for 3DMark 2001SE, it won't run with DX9. You need patch 330.
3DMark®2001 Second Edition Patch (Build 330)
This patch updates your 3DMark2001 SE (Build 300) to 3DMark2001 SE (Build 330)!
Important Note: This patch should be used only with 3DMark2001 SE (build 300) and not with 3DMark2001 (build 200)! http://www.futuremark.com/download/?...001patch.shtml |

actually thats a good point, but i think GK is already using build 330. The problems only appeared after installing new drivers.
Plus the error from using an old build with dx9 is different, it tells you its unable to run as it requires directx8.1 or above to run.
