It's a nice rebuttal and one that I think is a bit overdue in coming out. I really hope that the guys at SCO come out looking like fools after this one is all done.

Interesting.. I have been kind of interested in what's going on. Just started to really read up on it yesterday. Hopefully the SCO does look like complete fools after this is over.

They look like complete fools already. Especially as they STILL have their linux distro on the site (With a 2.4 kernel) when they are suing IBM over trade secrets, and are violating the GPL by doing so, as they have it up for download. Also they claim to have known about it for a long time, which clearly can't have been the case. I think somone just dreamt it one night, woke up and decided to sue IBM over the Linux Kernel.

It is absolutely crazy... I went to the trouble of downloading the SCO Linux kernel RPM from their FTP site, unpacking it, and checking the kernel source inside against the 2.4.13 tarball from kernel.org.

They check out identical. And since the only legal way to distribute the kernel is by accepting the GPL, SCO will have to either allow anyone to use their alleged code under the GPL, or get sued by Linus and every other kernel contributor.

It's not like they are obliged to keep that RPM on their FTP site - they must know it's there (every one else does) and as they allege to know the details of the infringing code, they should be able to remove it from the kernel sources they're distributing.

SCO quite simply can't both keep up this allegation and distribute other people's work without a license - which leaves them only the option of ceasing to be a Linux vendor. Great work SCO!
