Nagging legal question?

I have discussed this with friends and they are as clueless as I am. When it comes to music or dvds etc whatever.


Here is my question. If I had bought a used cd and then I made a personal backup on my computer and then later on I sold the cd would it be illegal to have it on my computer still?

I am no lawyer and just wondered how the legal system would look at this. Thanks for any advice or opinions.

So what you are saying is I need the disc lieing around the house somewhere for it to be legal correct?

yes, it would be illegal to keep the music files on your computer. when ownership of music material changes hands, the original owner (the seller) is *supposed* to destroy any & all recorded copies, even if the recorded format is different.

the same goes if you made a cassette tape recording of an audio cd. if you sell or give away the cd, you are suppoed to destroy the cassette tape.

well that answers that question I guess everone who has the beatles on cassette in their 69 mustang floor better burn it before they go to jail. Thanks yall I have a few songs to delete

Yeah I was just stating that I do not think anyone here doesnt have a burned cd or cassette that they got from a friend or co-worker and they probably do not even realize that they are breaking the "LAW" That is why I wanted to know. Many people do not break the law intentionally, they just do not realize they are doing it. I know ignorance is no excuse, hence my question.

what about if the origninal was destroyed, you no longer own the original, but the backup is serving its purpose

Thats a good question also such as maybe it was stepped on scratched or melted would you still need to keep the non-working version for proof say in a junk box or something?
