Best Course of Action?

Almost a week ago I received a linksys BEFSX41 router and have had nothing but problems. I can get the unit to "work" but the speeds are inconsistent and incredibly slow. After calling my phone company, linksys tech support, and my ISP, the problem is stil lresolved and the possibliity of a faulty unit was suggested. Therefore I would like an opinion on what to do next (I've never had to deal with an RMA process before).

I ordered the part from Newegg:
I looked at there policy and it says that they do not cross-ship (they send replacement first, then I send old unit back). Directly from linksys does however offer this.

1) Should I just try to explain the situation to Newegg and see about getting an exact replacement? The only reason I wonder about this is because the router seems to have nitorious firmware problems which I found out after doing a bunch of research.
2) Should I try to take it back, hoping to get the restocking fee waived and order a different model (In which case what would you suggest. I'm looking for a simple to setup/use router for an ADSL connection with a support for 4 computers).
3) Should I try to RMA the unit directly from Linksys? (I dont even know if this is possible, b/c I've never had to RMA anythign before).

If you do RMA it, I would RMA it to newegg rather than Linksys. You would have to go without a router for a week or so, but Newegg is very fast with returns.

First of all though, I would try reloading the firmware. Goto http://www.linksys.com/download/ , choose your router and OS, and get the firmware. Reload the firmware, and see if that fixes anything.
