It can be depending on the situation.

At work: I'm the Network Admin trying to fix a network problem... yes.

At home: I'm trying to sniff other customer's traffic... maybe not illegal, but at least again most ISP's TOS agreement.

There are plenty of legitimate reasons to sniff packets. You could use a packet sniffer find a computer on your network with a virus that's sending out information automatically to some place on the internet (I've seen one).

Many workplaces inform you that if you use their network, you consent to monitoring. How else would they know if you're going to porn sites unless they're "sniffing" packets?
