Tek 21 uses this information to contact you regarding your DeskPlayer™ when necessary (e.g., when maintenance is required) and to notify you of relevant DeskPlayer™ enhancements. Subsequently, we may contact you through the DeskPlayer™ to ask you additional questions from time to time, but your decision to answer these additional questions will be voluntary. Tek 21 may make use of this additional information, as well as information gathered in the registration process, such as age, gender, and income, to provide users with more relevant advertising and service options. You will be given the opportunity to choose whether or not Tek 21 may use or share your information for the stated purposes. At any time, you may change your profile on the DeskPlayer™ panel by clicking the Options button (DeskPlayer logo) and selecting "Update Personal Info".
Operating Metrics
Tek 21 calculates certain operating metrics, such as the amount of time a game is running on your DeskPlayer™, the number of click-throughs a link receives, and the amount of time your DeskPlayer™; is running. This information is used on an aggregate basis only to help determine the most popular DeskPlayer™ functions. The information may also be used in aggregate as the basis for fees charged by Tek 21 to third parties for the placement of links on the DeskPlayer™. Tek 21 will not disclose any personally identifiable usage information without your express consent.
Server Processing
The DeskPlayer™ Server System, which enables your DeskPlayer™ to interact with Internet sites and with other DeskPlayers™, collects the following information when contacted by your DeskPlayer™:
IP Address - Your IP address is a 12-digit number (address) which your Internet Service Provider gives you each time you go on the Internet. Each of your requests for a page or other information contains this address, so that the site you are visiting knows where to send the page. The DeskPlayer™ Server System keeps a list of the IP addresses of DeskPlayer™ users to help diagnose problems with our servers or with the DeskPlayer™ technology.
Cookies - A cookie is a piece of data that our servers may store on your computer's hard drive. The cookie will contain information about your computer; but the communication between our server and the cookie does not involve any information which would identify you. The DeskPlayer™ Server System may use cookies to save your password to make the access to member functions of our Website convenient and so you don't have to re-enter it each time you use your DeskPlayer™, to automatically access your e-mail account and determine whether you have new messages, and other functional uses. Cookies can also enable us to track and target the interests of DeskPlayer™ users, so we can enhance the DeskPlayer™ experience. We can also use cookies to track your use of the links installed on your DeskPlayer™. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. Your refusal to accept a cookie may, however, limit some functions of your DeskPlayer™. Certain advertisers who place ads or sponsorships on your DeskPlayer™ may use cookies; however, Tek 21 will have no access to or control over those cookies.
Environment Variables - Environment variables are things such as time, type of Web browser being used, the operating system or platform, and CPU speed. This information is generally used to ensure that you are shown pages and software that is compatible with your system.
Procedure Regarding Children Under 13
We do not collect individually identifiable information from children under the age of 13. When an individual who is registering for a DeskPlayer™ indicates that s/he is under the age of 13, the registration process is terminated, and no information about the individual is recorded in the files of Tek 21 or the Sponsor of the DeskPlayer™.
Advertisers, Affiliates and Links
Our primary goal in collecting personal information is to provide you a customized experience on your DeskPlayer™. In order to provide you a DeskPlayer™; free of charge, we broadcast and display advertisements, and install links to the Websites of our affiliates. By knowing something about you, Tek 21 is able to deliver more relevant advertisements and links to your DeskPlayer™. In this process, the advertisers and affiliates never have access to information about individuals, but only information that we have compiled about groups of DeskPlayer™ users.
From time to time Tek 21 may partner with another party to provide specific services through your DeskPlayer™. When you indicate your willingness to accept these services, we will share names or other contact information that is necessary for the third party to provide these services. These parties will not be allowed to use personally identifiable information except for the purpose of providing these services.Your DeskPlayer™ will contain links to third party Websites. Personally identifiable information about you may be collected at these Websites. Please be aware that Tek 21 is not responsible for the privacy practices of Websites linked to the DeskPlayer™. You should read the privacy statement of any Website that collects personally identifiable information about you.
Use of Information in Legal Affairs
In the event that a legal jurisdiction is conducting a valid investigation of activities deemed to be illegal, such as imposturing, harassment, distribution of viruses, eavesdropping, trespassing, spoofing or fraud, Tek 21 will permit authorized officers of the court access to all its information in order to determine whether a DeskPlayer™ user is responsible for such illegal activity. Your IP and dynamic IP may be traced for this purpose. In addition, Tek 21 may also disclose information about users in special cases when we have reason to believe that this information is necessary to identify, contact or bring legal action against someone who is using a DeskPlayer™ to interfere with the personal or property rights of another person, either intentionally or unintentionally.
Security
Tek 21 takes every precaution to protect our users’ information. When users submit sensitive information via their DeskPlayer™, the information is protected both online and off-line. While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect user-information off-line. All of our users’ information, not just the sensitive information mentioned above, is stored on our servers. The servers are located in a locked cabinet at a facility maintained by Telehouse and XO in New York City. Telehouse and XO protect the servers from unauthorized access by an access card entry system, as well as video surveillance and an infrared alarm system. We restrict access to the personally identifiable information on our servers to employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative). Furthermore, all employees are kept up-to-date on our security and privacy practices. Every quarter, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our customer’s information is protected. Unfortunately, however, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, Tek 21 cannot ensure or warrant the security of any information that you transmit to us.
Correction/Updating Personal Information
If your personally identifiable information changes (such as your zip code), or if you wish to terminate use of your DeskPlayer™, you can notify us by e-mail to info@deskplayer.com or by writing to Tek 21, 100 South Elmwood Avenue, Suite 200, Buffalo, NY 14202.
Notification of Changes
If we decide to change our privacy policy, we will notify you of those changes by e-mail, so that you will always be aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected unless we receive the user’s consent to a modification of the policy. |
although they will think we are all fatal xception due to the link bypassing the registration page.
