There were reported a couple of hundred lawsuits. It is a a scare tactic.

I think that this has the potential of backfiring. To be successful, they must prove that the individual sued actually did the downloading. If you have a network, how do they know that the person they are suing is actually the guilty party?

Better yet, if you have a wireless network, how do they know that someone on the street outsdie isn't taping in and downoading on your main IP address? Answer: they don't and I think this is an excellent defense.

BTW, there are more people downloading music than vote for president.

Did you hear that the rate of downloads actually increased?

I rather suspect that not only is this not an excellent defence, it is not a defence at all.

I would think that anyone relying on such an excuse would find themselves under considerable pressure to prove that the WLAN they operate had been compromised and that they had taken suitable steps to secure it.

I fear you would have about as much luck with "Well you see officer.. I am a very trusting person and leave my door wide open every night, anyone could have used my computer and downloaded those 3000 albums".

Only time will tell

When accused u dont have to prove that things did happen that way SpookyEddy. Simply that it COULD HAVE happened. Could some one have accessed their wireless network? If yes.. (wireless networks setup @ homes accross the nation are extreamly easy to get into) then then the prosicutor has to prove it DIDNT happen.

Yes, just like they have to prove that someone wasn't breaking into your house every night and using your computer to download music. In practice that is unlikely to be the case unless you can convince someone otherwise.

Well if anybody needs stats I can give u a log of all the hot spots I find in orlando when driving in Residential / Business areas. My record is 10 in 5 minutes. I dont consider it hacking when Windows XP automatically finds the network and logs on. My guess is if one was to look for the networks it would increase greatly.

there is no law to enable any kind of secuirty settings onto your wireless network.

and most people have no knowledge of how to enable wireless protection as my thread proves it. phenious is also correct with windows xp ability to automagically log onto others networks.

http://www.techimo.com/forum/showthr...light=wireless

and with neighbors and wireless network becoming so popular its hard to pinpoint where and what a connection is coming from. OF course with these easy home routers, there are no real logs that are kepted unless its something third party. So you can use the defense, but to provide paper work showing someone else came on is a harder thing

its not uncommon, using your same idiology Spookey can hold people accountable for computers that were taking over cause they didnt install the newest patch and there machine was part of the mass sending of a virus?

*hopefully my post doesnt sound like an attack

i would consider every program being watched, but they are going after the more popular programs

People just arnt willing to spend the time to secure their accounts I guess... that goes for people who still use wires as well, and not all routers make you safe, even when u have a router I recomend running a firewall. GZ3 Join the live chat, we are still talking about this subject
