Should you be able to be ticketed for an open container of alcohol?

I feel that if you are not DWI they should not be able to ticket
for such an offence. I feel that they have the right to give you a
sobriety check or breath test because of the reasonable doubt. But you should not be punished if you have committed no safety infraction

Or if your passengers decide that they want to party on the way to the next destination.

It would appear as if this law is presuming guilt and therefore wrong.

You can't have a police state here and kerb everyone's freedom. This Bush and the other dude, the AG, are taking things to an extreme.

The question should be whether there's alcohol in the driver, not in the car.

In Ontario, it used to be the law that if you bought a bottle of liquor at the LCBO (the Liquor Control Board of Ontario; only place you could buy it), it had to be your last stop before going home. Talk about silly.

I got a ticket once for having 2 empties on the floor in my back seat. My friend and I were on the way to a concert and got there early. We stopped at a park and each had a sandwich and a beer. This was maybe 10 miles from the concert. We threw the empties in the back with the trash, got in the car and drove the rest of the way.

The concert was in Wisconsin. We had Illinois plates. We were stopped in an area where there were about 10 other cars pulled over one either side of the road. All of the cars that I saw pulled over had Illinois plates. When the cop came to my window I asked why he pulled me over. He didn't say anything but looked around in the front seat. When he didn't see anything he looked in the back seat. When he found the empties he cited me for open containers of alcohol.

He wanted me to pay $120 on the spot. I told him I only had $20. He said he'd take that. He walked me into a barn where the sheriff was running a cash register. He gave me a receipt for my $20 and let me on my way.

No, I don't think open containers are enough to charge someone.

nope, and why should you be tested? here in switzerland every second man or even women have a beer in their hand and i dont seem to understand why this should be punished?

Sobriety tested and give them ticket/take them if they fail the test.

even one beer impairs your ability to drive. (slightly) each one after that kinda is logarithmically worse.

Drinking and driving is not cool man. but your passengers getting plastered is funny as hell.

when they get really drunk close the windows and turn up the heat and watch them get sick all over moms seats.
