I might call it political speech considering that the shots were in the air. (however that is not exactly safe either lead falls near 200 mph) Leave a hell of a dent in someones head.
But going easy on him considering that he was not attempting to kill any one would not be completely out of the question IMO.
I would not let him go scott free though. Some jail time is definitely in order if nothing more than to tell him that you can not intimidate people with guns either.

The AT in the quote is a bit unfair don't ya think. kinda like comparing someone who says they are gonna kick your butt and actually someone assaulting you.
The story keeps trying to compare violent actions with threatened or implied violence.
