How does RIAA get a search warrant to enter your house?

If they determine that you we on-line when a down load occured they can get a search warrant singed by a law clerk. That is not good enough to get you inside the door to inspect someone's hard drive. What exactly is phase 2?

The same question again, why does an ISP keep these records. Billings are by the month, why keep records of where and when your customers surf? Why keep the "user's IP adresses visited" file for more than 24 hours? Makes no sense to me.

...I don't think there are many ISPs that keep track of that...that's a LOT of data in logs...most of which would be illegible.

Cable ISP's will find it impossible to track surfing habits. Scary thought though.

It wont happen---a search warrant isnt all that easily obtainable, rediculous to even think of for something so benign unless you are making a business of selling fraudulant copies by the 1000's---

Right, but they see that IP address such and such downloaded from Kazaa using ISP so and so. Now they go to ISP so and so and ask for the name of the person who did the down load so they can intimidate him. ISP should have no way to pull up this information. They should have no reason to acquire it, let alone keep it.

Why are they keeping it?

I'm not worrying, I just would like to trap them and join the inevitable class action law suit. I am planning on downloading lots of public-domain Christmas carols.

Havent you guys been paying attention ? The laws are being re-written to allow this to happen. UNLESS we stop them now.


By the way, Chuckie it is federal law that an isp keep track of everywhere you go so "the feds" can prevent any terrorist acts.
It doesnt matter if your innocent they are required to track you anyway. the Feds figure your guilty. Previously their excuse was to catch pedophiles before that "sex offenders" , before that "hackers" ETC. ETC.

You get the idea dont you??

Most of the people they will be looking at for downloading music are those sharing Gigs of music.
Generally those that are sharing Gigs of music are using broadband to do so.
Since while using broadband you'll have a fixed IP # assigned to that broadband modem and those IT professionals hired by the RIAA will simply browse your shared Kazaa folder to see what you have, and then do a file transfer from your folder and bingo they have your IP#.
After that it's quite simple to run a program like Neotrace to find out exactly who to contact to get your personal information since there is now a court order in effect that says your ISP must provide your contact information to the RIAA so that they may be able to have the copyright laws enforced.

There are legal places to download individual songs now for a small price. You could avoid all this by purchasing the stuff legally and avoid all this anger.

They don't need a search warrant. They're not entering your home any more than the people you're sharing files with are. You've allowed them access to your files.

If they can identify you from your IP address (and the courts have agreed that Verizon, for example, can be forced to disgorge that information) and you're using a file-sharing program, that's the ball game.
