Workplace Laws

if it snows, and you personally do not believe that it is safe to drive on, and because of such you do not or can not go to work that day, can your company legally hold it against you?

you personally
Thats where the problem is. If you have proof from the traffic people that they are saying it's unsafe then I would think your company would have to allow you to stay home without a mark on your employment record but if it is just "your" view then it will most likely be up to the courts

It depends

do you have paid time? that is personal, vacation, sick time?

did anyone else in the office not make it in that day?

is your attendence record good?

my driveway drifts badly - when theres a big snow - and I have to shovel - I'm usually late. The big one this winter, the office closed.

we've got an older woman in the office who - at the first sign of accumulation - will leave - given her age and the fact that shes's part-time (non-benefit) its fine - everyone else has to use paid time or make-up their hours (if that is possible - it is not always the case) If the office closes - thats another matter - all benefit employees get paid as if it were a holiday.

we've only closed twice in 10yrs.

The Corporation I work for, the "Evil Empire" has Dual-Policy regarding Snow Days.

Management & Clerical Help can take personal/vacation time during Snow Days.

Union Help cannot, you will be Docked if you do not show up.

One thing we must remember, large corporations are Not immune to Federal or State Law..
The question is, do you have the proceeds available to take them through the appeals processes all the way to the Supreme Court ?

Not usually, so we have to eat feces with a spoon and fake a smile.
