about some "friends" of mine who had some court dates upcoming and needed advice.
Well, I was coming up on my 1000th post so I figured todays court action would be a good one for that.
Turns out "Bill" and "Sue" (the good guys) did NOT hire a lawyer to defend the 5 charges against them, they represented themselves.
They pretty much win in big fashoin...they were cleared of all the charges against them and (Bill anyway) had some fun showing "Joe" to be the lying piece of dirt that he is.
Time and tiredness prevent me from giving too many details but I will give a taste of the proceedings.
To inform those who didnt read the other thread..."Joe" (the scumbag) after a warrant was sworn out on him for assaulting Bills mother, swore out a false warrant about a TOTALLY made-up invented story about Bill assaulting Joe one night. Joe, being the psychopath that he is, also either gave himself a slight black eye or had someone else do it...and he had pics of it, lol. Is this dude a psycho or what.
Bill was at Bible study with 4 other peeps at the time that Joe's sworn statement said Bill was assaulting Joe.
There was a taped phone conversation between "Joe" and Bills sister that "Joe" didnt know about. Since Joe and his wife are big fat chronic liars, Bill had quite a bit of fun asking them questions along these lines.
Bill: Joe, did you obtain a doctors report about the bruise on youre eye?
Joe: No
Bill: Joe, did you go to the hospital as a result of the alleged assault against you?
Joe: No
Bill: You didnt?
Joe: No
Bill: Joe, isn't it true that you had a phone conversation with my sister in which you told her you went to the hospital and got a doctors report about your eye?
Joe: no.
Bill: Have you had a phone conversation with my sister concerning the matters we are in court about today?
Joe: No, I did see her on MSN chat one night.
Bill: but you didnt have a phone conversation with her?
Joe: Oh yeah I did, I remember now.
Bill: wait, you said you didnt have the phone conversation and now you are saying you did, which is it?
Joe: I did.
Bill: Did you tell her you went to the hospital and got a doctors report about your eye?
Joe: No
Bill: No further questions for Joe your honor, i would like to call my sister as a witness.
(lets call Bills sister "Julie")
Bill: Julie, did you have a phone conversation with Joe concerning the matters that we are in court about today?
julie: yes
Bill: Did joe tell you that he went to the hospital and got a doctors report about his eye?
Julie: yes
Bill: Did you happen to record that phone conversation?
Julie: yes
Bill: and do you have that tape with you now?
Julie: yes I do
Naturally the tape went on to show that joe is a sorry lie telling dog. Fun stuff.
Bill enjoyed asking Joe and his wife lots of questions about the assault charge against Bill and the trespassing charge against Bill.
At the beginning the judge seperated all the witnesses and sent them out of the room. So that means that Joes wife couldnt hear Joes lies to Bills questions so when she came in she had to make her own lies up and frankly, it was hilarious to hear it.
Joe had said that he was going down the road and saw Bill pulling out of Bills road and that Joe fell in behind Bill (and that Bill puled over and assaulted Joe)....so Bill asked Joe along these lines.
Bill: Joe, how far up the road were you when you saw me pulling out of my road?
Joe: (Spreads his fingers apart about 4 inches) About that much.
Bill: (totally astonished and wondering why the white coat men havent got Joe yet) About 4 inches??
Joe: uh huh
Bill: you were 4 inches from me when I pulled out?
Joe: uh huh
Bill: and I pulled out in front of you? (incredulous)
Joe: uh huh
Bill: no further questions your honor.
Fun stuff.
Anyway joe was found guilty of the assault on Bills mom and also of trespassing with the intent to disturb private property (or some crap like that, cant rememebr).
Joe has a pretty good sized record already...burglary, assault while on probation etc.
Sue, bills mom, didnt put every detail of the assault on her complaint when she filled it out the night it happened. Because of that Joe didnt get all the time he should have. She also didnt take pictures of the bruises on her legs showing that Joe had pinned her down. (She did have extensive pics of the bruises on her arms where he grabbed her and forced her thru the house)
he ended up getting about $200 fines altogether and 6 months suspended for the trespass and he got 12 months, 10 months of that suspended for the assault. he got of pretty light, only 2 months in Jail and who knows he may have weekends off even though he doesnt work he gets SSI.
The judge did tell him it was ridiculous for him to touch his aunt like that (and had strong words for Joe and others in his family) and that if there were any better evidence that it went beyong him grabbing her shoulders that he would be getting a solid year in Jail. (all because Sue left out 2 details on her report the dude gets 10 months lighter time...too bad...only a measure of justice was served but better than none)
Anyway, its all turned out pretty good so far. Its nice to see truth win out sometimes.
