I would hope that any logical judge would immediately throw out the case against google considering they don't purposely spread the information, its part of the normal process and is conveyed the same way as any information.. now if google was to put a big banner on the front saying look at this then maybe.
if the company didn't suck, they wouldn't of gotten bad reviews.
