This is definitely not a win-win situation, Martoch. There have been courts unable to decide what to do about this, so it makes my opinion kinda puny in comparison.
Kinda like drunks. Who has the right not to allow someone to booze themselves into cirrhosis? If they don't DUI and don't hurt anyone else, is it illegal? Or even immoral?
Now, I know the case here is the foetus not the mother, but when does the foetus begin it's own identity, and when does the mother's rights to her own body stop?
I'm not supporting women who smoke whilst pregnant; far from it. But is it up to me to make her stop?
As a health professional, I possibly would have a word to her about the potential effects on her unborn child, given the right opportunity. But that is all I would do. I would also reinforce it is her choice, provided she understands the risks she runs. I would NOT attempt to superimpose my opinons onto her.
That's my opinion anyway.

PS Martoch - I don't really think that much will be achieved by bashing smokers with more anti-smoking information. They get enough already, and still choose to continue. All we can do is encourage them not to harm others if they persist in their habit. IMO, anyway
