The crazy landlady
hi,
i went to my g/f''s apt tonight to try to smooth over a problem. she has lived there for only 3 months. she doesnt drink, smoke, do crack, blast her music or stay up late. last week her friend from florida stayed for a few days. even though signed a rental agreement saying she wouldnt have overnight guests,(dumb move on her part, i had no idea) this lady gave no warnings, asked nothing, just simply asked her to leave. get out. goodbye. no warnings, no 2nd changes. nothing.
now here in new york on the island a basement apt is pretty much illegal and the owner is subject to serious fines if found out.
enter me the idiot trying to do the right thing. i went over to try to talk to this lady and i tell you man, i was as nice as could be that is almost sickened me. she didnt let me in even though i asked her nicely if i could talk to her. so i sat outside in the cold and told her how much it will never happen again, and how sorry. she was.
i tried, and tried, and tried, and tried to reason and ask her for a second chance. that was a no-go. so i had to pull out the ammunition. i tell her, " not for nothing but you know this is a illegal apartment"......................(again, i said this so nicely)and thats all it took.
" WHO TOLD YOU IT WAS ILLEGAL?!!!!" (totally defensive, stepping back almost). i explain to her that almost all basement apartments are illegal here. she then claimed i was threatening her and closed the door on my face. end of story.
it all comes down to how long my g/f wants to stay. it will take about 6 months for a sheriff to evict her and if the landlady changes the locks she'll be arrested for barring access to private property. i didnt even get to get into the fact about the irs and not reporting all the money shes been making and not paying taxes on, about the town not knowing about the aptartment, lawyers, fines, yadda yadda etc.
i wonder how long id put up with it. she has no place to go unlike me. i could move back home if i had to. she cant. pretty fun night i had huh?

Pretty lame move on her part---she had the perfect tenant and is now gambling on the next one---

Tell the g/f to stay put, send the "Check" in and EARLY !
Keep the apt and just dare the old witch to do anything about it.
If it's illegal, then how in the world could she dare call for an evicition.
Here, it's a 30 day deal to get someone evicted.

Brazen it out, but plan an exit.
Eviction here can take as little as 7 to 14 days. Depending on the contracts involved the longest is still only 60 days...
But I would seriously get an exit in place and keep it up to date the first month...

Ya know, Willy, I think it's horrible when a landlord would treat a human being like a commodity. When someone rents a place, they are putting their life in that place, and going to a great deal of trouble to do so. For this witch to treat your g/f this way is unconscionable.
I usually say "well, don't sink to their level, walk away, choose your battles carefully..." etc. etc. Well, I would choose this battle, all right.
Make this jerk initiate eviction proceedings. Squat on the place as long as possible...and when it happens, THEN use the "illegal dwelling" law against her, and if that IRS business can be brought to bear, do that, too.
All out war. This creep deserves no better. |

Personally I would find something else as soon as possible. I would not want to rent from someone who treats me like that or monitors my actions so closely.
I like to keep my home "my" private area and what goes on behind "my" doors should be "my" business as long as I do nothing illegal, pay my rent and return the unit as nice as I received it (except normal wear).

i feel the same but its not my place. as for her i think shes going to start looking for a new place but she'll have more than a month. know how you can tell when someone has some screws loose upstairs? that was this lady as soon as she said her 1st word to me. i just knew. this wackjob also said one of my g/f's friends used the "f" word alot...........obviously this lady has her ear to the floor or something.

She's your GF, let her move in with you.
I don't know about the 7 - 14 day thing CERupple. I did some digging on MSU's website and from what I've seen, a landlord can not force you out w/out a 30 day notice. Even if they have just cause. It's illegal to put a tenant into a homeless situation in Michigan. From what I gather, they can't evict at all if there's snow on the ground.
Want another fun way to stay somewhere you're not wanted? Bring an animal. Even if it's specifically not allowed on the lease. Then when they evict you, you say that the animal has nowhere else to go. Call whichever animal rights agency it is that handles that stuff (it's been a while, I forget). Surefire way to put the fear of God in landlord. :P
Luckily, all of my past landlords have been pretty good. Heck, this is the first one I've actually had to pay rent on time to (just barely managing.  ).
I'd say find your G/F another place to live as soon as possible. Sure you can sick all those laws on the landlord, but if she knew it was a basement apartment and still rented it she's just as at fault as the landlord and can probably be held accountable also. It's just not worth the headache to deal with old angry people.

Like whir said, Id check with a legal person about the rules... is it possible your G/F could get in trouble for renting this apt. when she knows its Illegal? Isnt this entrapment or somthing?

One thing to do for sure, and quickly. Get any valuables or electronics OUT of there! Just in case the landlady does somehow get an eviction notice!
I don't know your state's laws, but here an eviction takes forever, but once ordered the landlord has the right to enter & empty the premises - usually by piling everything at the curb!
Of course, once that happens the scavengers hit & by the time the tenent gets there not much remains...
Also, there's no rule regarding how gently the landlord has to treat the tenant's stuff. A friend once had to "clear" his place after an ugly eviction. Nothing was kept by him, but NOTHING was carried out, either. Thrown hard instead. Rubble remained.
