How long do I ait (ripped off)

I won this auction

As you can see in the auction, shipping is promised 1 business day after payment is received. I paid this , erm, individual on Monday via paypal.

Sooo, lets say that he doesn't "get it" till tuesday. That makes the ship date Wednesday right?

Well when there had been no shipping on thursday I send him an email inquiring about the ship date. The reply I received was that it would be shipped no later than today. Well it is 4:40 and I still have no tracking number.
I plan on emailing him again at 5:00 to see what he has to say.

My question is, how long should I give this guy before I call up my CC company and Paypal to rescind these payments?

I want to give this goon, ok tired of using individual, a chance, but I don't want to get ripped off.

I would have been nervous right after he said he didnt have it. Next time you email him, tell him what action you are taking.

Thanks Iron, did not know that such a tool existed

They sent me his phone number. I think I will be calling him tomorrow.

I'd pull his info and call him. There's no reason he should wait like this with sparse communication. If it says next day, then next day it is, not sometime this week. People, I used to love ebay, not so much anymore. Pm me if you will and lemme know what he says so we can work something out.

I just received a reply from him that he would ship it on Monday. This is BS, I sent this back to him.

I have received no response. Tomorrow I will call the number that ebay has listed but I have a feeling that it will not be a real number.

Am I justified in what I am doing? Or am I being unfair.

You're totally justified. Sounds like you have the same ailment as me...TNGS* You're worried about his rights while you're the one being shafted. If he really cared, he would have done what he said. I've sold upwards of 70 things on ebay (120+ rating) and always went out of my way to make sure it was done right. Therefore, no negatives, even when something didn't work. I paid shipping and refunded.

I'm obviously not sure, but looking at his 6 month feedback, I think you'll be OK. If he was really out to hose you, I doubt he'd be putting the effort into answering your e-mails.

For larger auctions (over $200-$250) I use an escrow service most of the time. A couple more bucks, but peace of mind...

I am tired of playing games with this guy. I called his "phone number" from ebay and suprise, suprise, it was disconnected.

I filed two Buyer Complaints with PayPal so I will know withing 10 days what he plans on doing.

I also contacted my credit card company, and they are willing to cancel the payment for me.

Thirdly I sent him another wonderful email, so we shall see if he replies to me.

Remind me why I never buy on ebay again?
