There are so many people trying to get their money back, including at least five of their suppliers who have court cases against them, that there can't possibly be enough money to go around. There should be some kind of criminal prosecution against these people, what they did to customers was clearly illegal, but I don't have much faith that that justice will be done for those who lost their hard earned money.Just trying to get real information on these people is like pulling teeth.

suppliers, retail customers unite

How can suppliers have court cases against them? Is that because the suppliers sent them stuff and Monarch did not pay? I assumed they would not ship goods until they received payment. Maybe it works differently at that level of business. So they are being sued by suppliers

How can retail, e-tail customers get in on this? If enough complain doesn't it become a class-action lawsuit against them?

I would imagine Monarch had a line of credit with their suppliers, and they ended up cheating them the same way they cheated the customers. These are all individual lawsuits filed by the companies,I think a class action suit has to be filed as such. The tax commission got their money from them by the simple action of seizing their inventory until they paid off their back taxes.

It sucks and it's unfair, but a lawsuit against Monarch won't fly. Unless you can prove that the owners were engaged in willful deceit, it won't go anywhere. They were incorporated, and as such the owners are protected.

aarrojb has a point.
1. First debs on money owed goes to the tax man.
2. Creditors get second debs on money owed.
3. Customers get to share what's left, if anything.

I'd also point out that in a civil suit you, not the court, have to recover any funds due too you. In other words, even if you win, you have to collect any money from Monarch, or the owners (which is a whole different ballgame). The court will not actively assist you in getting your money back. Even if you go for a wage garnishment you will have to pay for it, not the court.

The plaintiff(s) have to collect their own money. Sorry, (and sad) but that's the way it happens.

It might be possible to prove willfull deceit, lord knows there are enough ripped off customers to show a pattern of that, but getting the money would be another matter. It's the lack of any investigation into their activities by any government agency that disappoints me,something needs to be done to get a handle on online fraud and scammers.

Understand, but at this time this case, IMO, is still in the hands of the Office of the Attorney General of Georgia. Until all the complaints reach a monetary value of at least $700,000. Then the Fed might get involved. Otherwise you are still in State court, Georgia in this case.

And when I say $700,000, I mean all consumer complaints combined. Don't get me wrong, there are other factors, but this is the main one.
