What would you do?

Ok so awhile back I made a purchase from this guy, sent him the money via pay-pal didn't use my cc wich I kinda thought I should have but wanted to make it easier for us both, and he says he shipped it. No tacking nothing and he says it was going to take awhile because the deal he gave me was a pretty good one and he wanted to save a few bucks on the shiopping cost. Wich had I known he was that worried about it I would have sent more money but it was already too late. {that whole thing seemed a bit odd to me}

Well the item never arrives, so I email him. He's kept really good contact and emailed me several times and always responds to my emails and he emails me back and says well it should have been there by now but that he's never lost anything in the mail. So I say ok I'll give it a few more days and see. Another week goes by and nothing. So I email him again and told him that it never arrives and that I think something fishy is going on here.

His response is do whatever you want but I'm not sending your money back cause I'm out the item and not going to be out the money. He says take it up with pay-pal. We'll the guy lives in canada the email I sent the money too was a verified account, he had no refferences but had no bad heatware or nothing I could find that states he's a bad trader. I kinda feel like I'm getting cheated but I don't really see a bad trader being willing to keep good contact. Its not that much money and I could care less about the moeny but its the principle.

what do you guys think??? scammed or not? leave a nad heatware and post him as a bad trader or what?

That's a tough one, you want to give the guy the benefit of the doubt and all, but I, for one, would give you the $$$ if it wasn't that much. My rating is that important to me.
Recently, I missed a book order from half.com b/c I didn't confirm in time, I still send the book at my cost for free to maintain my rating.
If this guy's rating mattered to him, he'd at least give you half the cash. I see it like, since it's not that important to him, go ahead and leave neutral feedback at best.

how much money ya talking ? how did he mail it . you might just be beat i am sorry to say . try more emails to work it out and if that don't work leave bad heat and chalk it up to experence

hmm you don`t really know if this guy is cheating on you, beside he kept contact all the time as you said.
I would post a negative heatware, though explaining what was the problem. In the end you spent money which he got and you were without your item.

He could have requested a track number for 45cents more!

Though decision....sorry went like this

we are talking about less than $20 like i said its not an issue of the money I'm really not worried about that but its the principal. As for more contact I don't see that going anywhere. I'm just trying to give him the benefit of the doubt as I always do.

The Seller has the obligation to insure you recieve the item within a reasonable amount of time. If it does not arrive - The Seller must replace or refund.

The Troll Hunters are the best resource to resolve this.
