Their
Return Policy,
Quote:
Special Orders
Select items sold on Jomashop.com may be considered a "Special Order" and subject to a limited return policy. A "Special Order" may be items that we do not have in our warehouse, items that we do not have on our website which are special ordered from our distributor, or orders that have a sale price equal or greater than $4000, the return of these items/orders will have a restocking fee of 8% or final sale policies unless otherwise agreed by the Jomashop.com staff via mail, fax or e-mail.

The return policy clearly states that any order over a $4000 amount is a 'Special Order' and is subject to a 8% restocking fee. Regardless if it is in stock or not, it is still over the $4000 dollar limit. So therefore your order does fall under their 'Special Order' designation.
I assume that a Rolex with the date would cost more then one without. So why not just get that and then there would be no problem. The company has offered you are fair exchange IMHO.
I do not see that the BBB will do much as this is within the companies stated policies.
