My problem is: I don't know who will be in the small claim suit name & address.

Nomaxim gave me this info:
Complaint Contact Ms. Rainey DiGiacomo (Complaint Contact)
Other Contacts Mr. Alvan Weiss (President)
Do you think I should put Cutting Edge Appliances Alvan Weiss (President)?
I'm sure there is also a forwarding address through the Post office or change of address. Is the Post office address public record? Can I ask the Postmaster
if there is an address associated with Cutting Edge Appliances or Alvan Weiss?

In my state of Connecticut, if you pay extra, the Sheriff assigned to the case will research and hand the lawsuit to the dependant. I don't know in PA.

Other things mentioned here is the creditors; any idea how I can research Cutting Edge Appliances creditors? This is a tough one.

Thanks a lot
Che
Your legal action will be against the company, but I would add et la to the defends line..

Che Che, You are not alone only I did receive my stove but it was so destroyed that it's not usable(maybe that's why the shipping was free). After trying to get them to replace it with no results, we got a lawyer and he wrote, talked, and sent pictures of the stove to Mr. Weiss to no avail. Now the websight is not working and all the phones are disconnected temporarily. This whole thing has really set us back and we have no idea what will happen next.

I would love to join forces w/ other consumers that have been victims of AJAX and Van Weiss. He got me for $3600. I am looking to press charges, I have been in contact w/ the Ridley Park PD, the DA's office (fruitless) and the BBB. Fraud at a felony level is my take on the situation.

Wallace11 can anyone help me?

Wallace, I would love to see them be punished for their thefts if you find out anything you can count me in. We have a lawyer and he is now going to take the shippers to small claims court to see if that will get my stove replaced but they are probably going to claim that Ajax is responsible. I am really sorry for all of you who got nothing sent to you and I to think it is fraud. Have you considered trying to contact your states Attorney General's office to see if they have any advice? Maybe even Pennsylvania's state Attorney General's office? Keep me posted and anything we find out I will gladly share. Mariah

Well, I emailed the attorney representing Dacor and he replied that Ajax filed for bankruptcy when PNC Bank foreclosed on all of its assets. I ordered my range in August and it DID arrive at the end of October, but badly damaged. Fed EX National delivered it, and we marked it damaged on arrival. I would have kept it but after a week of trying to get the oven door to close I gave up. Ajax arranged for it to be picked up and "ordered" another. I put all of the paperwork in the oven when Fed Ex showed up and sent it on its way. Second range never transpired and Fed Ex sent ME a bill for $228.01 for picking up the damaged range!! Seems that the original shipping form is MIA-I sent mine back in the range and Ajax had the billing set up to be paid by me. So, I am battling Fed Ex at this time, and quite frankly they are extremly rude and unpleasant and could care less. As far as suit against Ajax, it will not happen. If we could hold him accountable personally that may be an avenue to pursue. Have you contacted the Ridley Park PD? Sgt. Snyder is investigating-at least he could add your name to the list if something happens. The number is 610-532-9631. Good luck.

Wallace11 have you tried this?

I was cruising around on line and came across a websight called Appliance Adviser and there was some information about Viking and Eurochef America making good on nondelivered goods from cutting edge so check it out and good luck. I called my stove's manufacturer Capital-Cooking and they said they would get back to me today but they didn't so I don't think my odds are looking too good. Hope springs eternal though.

We have also received notices from Weiss' attorney, informing us of a meeting of creditors scheduled to be on Thursday, January 24, 2008 at 12:00 p.m. at the Ofice of U.S. Trustee Meeting Room, 833 Chestnut Street, Suite 500, Philadelphia, PA 19107

I hope this helps some of you. We immediately called our credit card company when we discovered Weiss had "left town". Our appliances were ordered but not delivered.
