Final Settlement
I spoke with the DA's office and they said that a final settlement had been reached with Wesley Forrester.
Would anyone provide any information that can be shared here.

Here is what I found out:
1. The DA's case number is 49140..use that number when communicating with them. They can be reached at 530-889-7000.
2. Wesley has agreed to pay 43K in restitution. No idea on timeframe, etc. Final settlement conference was May 25th, so this is a relatively new development.
3. The Revenue Services Division (530-889-7786) will be the contact point for any communication re payments, etc.
One slightly concerning thing is the DA's office only had 9 names on record for restitution as part of the case. I'm told that is not a concern, as there is a larger list on record (or should be) that will be repaid. I'm waiting on a call back from the DA's office for verification that I am on the list. My thinking is it will not hurt to call and confirm one's name is on the list. I suspect there will be a point where the list will be locked down, and getting repaid will be difficult.

I talked to the DA last week and there is a restitution order along with his probation. I then called the department in charge of collecting and talked to the guy who is in charge of this case and he told me that Wesley is claiming poverty and living with a family member and does not have any income. He then told me about having past experiences with Wesley and that the odds were slim to none to ever collecting a dime from this low life.
If I hear anymore I will post it right away.

That truly sucks, but I guess I'm not surprised.
If I can find a little time, I might try to get whatever public court documents exist, and take a look to see what the conditions are regarding his probation, and the restitution. It would seem that if he fails to fulfill those terms, he goes to jail, right?
The scumbag needs to get a job, any job, so he can pay back the people he ripped off, no matter how menial he feels the work might be.

I agree. When I asked that very question I was told that restitution is part of his probation but "what can they do if he can not pay, keep him on probation the rest of his life?" My response of course was "yes they should".
I guess it depends on how many people contact them and put up a stink.
I try to call them at least every other month, and the people I have talked to have always been nice and sympathetic.
When I hear more I will let you all know.

I'm no legal expert, but I always thought that if you violated the terms of probation, you went to jail...

Was thinking about this a bit more, and may go ahead and do what I had been thinking of doing, which was requesting all documentation about the case from the DAs office. That should be public information, and I would think it would detail what Wesley has told them he has in assets, etc. Even better would be a courthouse property search, as I think he lived with his mom, but it would be interesting to know for sure.
The other thought goes back to what was previously mentioned, and that relates to a lien against any possessions or property. Not sure about CA law, but in FL, if you get a judgment, you can go for anything that is possessed by the person who the judgment is against..car, house, wages, etc.
Trouble is, for each/most of us, this is maybe a 300 dollar loss, so it is tough to justify getting an attorney involved, or even doing the work to file and get the judgment. It might be a little more solid/permanent than this probation crap, but at what cost? Even if you got a judgment including court/attorney costs, you still need to find something he has to attach to..
Long ago I wrote this off as money lost to a slimeball, but everything I get thinking about it, it p**ses me off to the point of wanting to dig in and see what can be done.

I got a check today for a whopping 5 dollars and change from the Placer County Courts..not sure if that is all the restitution I'll see, or just the first small small piece.
Wondering if anyone else got some money...

i received a check from placer co for 6 bucks and change,why dont they put that sob in work release so he has to pay us..

I did inquire as to where it all stands, and was told that "he has over a 100 people to reimburse", and as he pays each month, money will be doled out accordingly. He's into me for about 200 bucks, give or take, so I figure I should be paid off some time in 2010.
Makes me wonder now if a judgment and a garnishment would have been better...as in most states, judgments accrue interest.
And yea, you would think a job would be a condition of his probation.
