Two updates I have...
First, I e-mailed Elaine, asking if anything new was going on. I sense she is out of the loop on this one, as it is more the DA's matter. Here is her response: I haven't heard anything new. You can contact the DA at (530) 889-7000. You will need to reference Wesley Forrester and our case # 345-04-15072 and they will put you through to the DA handling the case (I think Ed Jones). Elaine
Second, I got a response from the Bureau of Electronic and Appliance Repair...to summarize..
"The Department of Consumer Affairs Bureau of Electronic and Appliance Repair has sent a case to the AG's office for dispensary action against the State registration of Wesley Forrester, dba Portable Computer".
They also mentioned it was their understanding the "DA was reviewing the case for possible criminal action".
My sense is, this one will fall thru the cracks if we do not start hounding Ed Jones to do something. I plan to hit him with a letter next week, and I'll let everyone know the response, if I get one.

I'm in the same boat, but I don't think the Roseville PD has my laptop.  .
Even if they did, I'm still out $300. I'm in Maryland, so it's silly for me to bring a civil suit and travel to CA.
So, I wonder if it makes sense for all of us who are in that position to bring suit together?

I've been meaning to call Ed Jones to get an update..will do that today or tomorrow and post any new news.
And sure, if there was a way to make Mr. Forrester's life miserable, count me in.

Got a voice mail from Ed Jones yesterday.
They are still trying to work out a restitution agreement as part of a guilty plea...there is a conference with Wesley's attorney next week related to the plea and the agreement.
Ed seemed very nice, said to call when desired for updates.

Yes I think we should all bring a lawsuit againt portablecomputer.com. I also got my laptop 'stolen' by Mr. Forrester. I wish to see him behind bars even if I don't get my laptop back . |

Ed Jones was very polite and easy to work with. Still waiting on further info, guess it won't be until the new year.

Class Action?
It might make sense to find a law firm to raise a class action lawsuit against him. I too was a victim, however I was one of the lucky ones to get mine back. i think I got mine back a week before the police raided his "shop". Very fortunate for this, but the housing for the LCD screen was damaged on my dell. I might just take it into a laptop repair shop and see what they say for how much it would cost. If it is trivial, I'll do it, but I still want WF to cover it, and eventhough I got my computer back, I am far from happy. You might contact your states attorney general, they might be able to help you resolve a claim. I think if a class action lawsuit appears against WF we might give him more than community service. He is a fraud, and I am glad he was shut down, but I feel bad for those who weren't lucky enough to get their computers back

Update
I just spoke with the district attorney prosecuting WF and the case is going to court on Feb 1, 2005 in the Placer County CA. The case is largely on restitution at this point and his attorney is trying to settle out of court and they are negotiating a final figure. Every day new police reports come in he said and they add claimants. It has slowed down now and they feel they have the final number of claimaints and the dollar figures to claim. The case number is already posted in an earlier posting. The DA, Ed Jones told me to call back Feb. 2, 2005.
