XP License rules and regs

I've got 2 questions that should be easy to answer but I don't know the answer to.

1) What are the rules about selling/trading an OEM license? For example - I've got an XP Home license from an HP system. What are the requirements there?

2) What are the rules about selling/trading OEM software without a license? For example - I've got Windows XP Pro for Dell PC but lost the license somewhere.

If its wrong - tell me its wrong and what reasons.

If I'm allowed to, tell me I'm allowed to.

No personal attacks, please. Just the facts.

I had an OEM copy of XP Pro with a missing product key and I called them and they gave it to me over the phone. Not sure if this is the same situation, but maybe my info will help.

I have bought keycodes from some sites on Pricewatch before. The seller actually sent me the sticker that goes on the machine, which I presume would be legal, as long as it was off a machine which had been upgraded or trashed or whatever.

Any responses from any of the moderators?

This would affect my decision on whether or not to sell each or either. Don't want to violate any rules.

Unless you fall under the Open, Select, or Enterprise licensing scheme, you need to sell the software with CD/COA/License, no exceptions.

What about the first part? (no software - just the license).


EDIT: Btw, thanks for the response. I've never had the situation of number 2 come up - but I knew there was something. I'll have to bookmark that page. *** removed on purpose ***

This site is creaking right now. Maybe its net congestion. Because the page took longer (and was still waiting) than 45 seconds to load - I pushed the wrong button guessing which one it is - and double posted - sooo... if I could have this specific posting removed...

Based on the reading, I can properly assume that

a) you cannot sell software without the CD/COA/License and

b) you can sell the "CD/COA/Licsense" without corresponding software - however it must be accompanied with a corresponding PC or computer hardware.

The only reason I am wanting to make sure is because I don't want to violate copyright. I've just found also a Windows 98 COA License as well as the Windows XP HE for HP (as stated above).

As I understand, to buy OEM w/o the CD, you'd have to be an OEM Reseller. We don't allow those, so there'd be no way to sell it here.

Therefore, to sell it here, you'd have to have CD/COA/License in order to stay in TechIMO's regulations.

It's kind of a tough call, but until I can find clearly in stone that it would be okay to sell it to a non-OEM Reseller though, that's how it's gonna stand.
