learn the lesson..dont be vague about things, they come back to bite you, lol.

I would tell the dude "look, you got a used computer for $200...I said I would try to help you if you had problems, I never said I would take the computer back several months down the road....if you would like me to look at it and see if I can fix the problem with it I will be glad to, but refunding the money is out of the question"


If dude doesnt have a written warranty and he bought a comp at a rock bottom price, I dont think a judge will side with him very strongly.

So returns and refunds are not implyed between private partys at the time of sale correct (it'd just make sence, but sometimes the law doesnt). He also said his lawyer works for him for free (ha) which i belive is an idle threat.

O hey if anyone could find (i'll look too) a state (MN) or federal law that states the implied legal matters in private party sales it would be great.

if his lawyer dows work for him for free its only if he looses if he wins he will have to pay for all the time spent plus a 10% commission but those kind are usually only used by regualr people suing large companys for large ammounts of money and i don't think any lawyer would even take this small of case for that type of matter

a bummer, indeed. He could try to take you to small claims, though I wouldn't count on him winning. I think you hit it on the head when you said he's a hothead. Considering his temper it wouldn't surprise me if the guy has abused the machine physically when it "doesn't do what I'm telling it to do!". That in turn has made him rationalize the fault onto your doorstep, and enraged him further by never coming to terms with the situation. (darn psychology classes...)

I wouldn't worry too much about it...though that's hard to do when you've taken someone's money and they're unhappy, no matter how insane they may be. It's an ethical thing...but don't feel guilty.

The store owner is more liable than you anyway since it was sold on his public store property...and considering the method in which he handled your personal info with an irate man, it's only carma for it to be left his legal responsibility (at least that's how the legality is here locally...other jurisdictions may have different laws).

Unless your state is truly bassackwards, there's no such thing as implied returns or refunds in a private sale. Once the money changes hands, that's it. It's over. It doesn't matter if Johnny Cochran is his father, there is absolutely nothing they can do. Tell him to shove the computer where the sun don't shine. If you don't want to tell him that then email me and I'll give you my number, tell him to call me. I'll be happy to set him straight.

If he threatens you, I would make a small suggestion about tax fraud, and he should quiet up pretty quickly...
