Refurbished is a misnomer. It has come to mean any "returned" product with a broken retail seal(no test, no rework). See the "Refurbished" area on the Newegg site and carefully read the disclaimer which probably applies to DD too. I have exactly the same problem regarding a Sapphire 7000 from Newegg which didn't fail until three weeks (one week after the RMA window) after delivery and the US agent, Althon Micro, just passes it back to Newegg, who are under agreement with Sapphire to handle warranty -- out of luck!
To encourage you, I had a Canon 5000 scanner also Newegg refurb arrive with a cracked glass. Canon handled the replacement, overnight free including shipping on return of bad unit!! Pursue Olympus directly at their HQ website and you may be pleasantly surprised.
