If someone is in your house I think the burden of proof should lie with the person who did not belong there.
The key operative word is "!!!{[(YOUR)]}!!!" House.
You can quite easily believe if someone is on your property they know that they do not belong there. They therefore assume the risks of all penalties that might be levied by the true owner.
How could that be wrong?
